Welcome to Ho! Ho! Ho! Greeting (“Ho! Ho! Ho! Greeting,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your access to and use of our website https://hohohogreeting.com (“Site”) and all related products and services, including personalized Santa video greetings, live virtual calls, and handwritten cards (“Services”).

By using our Site or purchasing our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old and legally competent to enter into this Agreement. Our Services are intended to be purchased by adults on behalf of children.

2. Description of Services

Ho! Ho! Ho! Greeting offers:

• Personalized prerecorded video greetingsfrom Santa;
• Optional handwritten cardsmailed to U.S. addresses.

We do not guarantee availability with a specific Santa performer.

3. Pricing and Payment

All prices are listed on our Site and processed securely through Stripe or other approved payment processors. Payment is due in full at the time of purchase. All charges are in U.S. Dollars.

4. Cancellations and Refunds

Because each video, call, or card is custom-created, all sales are final except under the following conditions.

By contacting us, filling out a form, or purchasing a Service, you consent to receive emails or text messages from us. These electronic communications satisfy any legal requirement that such communications be in writing. You may opt out of marketing emails at any time.

6. Children’s Privacy and Parental Consent

Our Services are created for children but must be purchased by adults. By submitting a child’s name, interests, or other information, you confirm that you are the parent or legal guardian and consent to our use of this information solely to fulfill your order in accordance with our Privacy Policy.

7. Intellectual Property

All materials on this Site—including videos, recordings, text, designs, and graphics—are the exclusive property of Ho! Ho! Ho! Greeting. You are granted a limited, non-transferable, non-exclusive license to use purchased videos or cards for personal, non-commercial enjoyment only.

You may not copy, distribute, modify, or publicly display any content without our prior written permission.

8. User Conduct and Prohibited Uses

You agree not to:

• Use bots, scripts, or scraping tools to collect data from our Site;
• Upload or transmit viruses or other harmful code;
• Post unlawful, obscene, defamatory, or abusive material;
• Impersonate any person or entity;
• Interfere with or disrupt the Site’s functionality or servers; or
• Reverse-engineer, decompile, or disassemble any part of the Site.

Violation of these rules may result in immediate termination of access and potential legal action.

You agree to indemnify and hold harmless Ho! Ho! Ho! Greeting, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including attorney fees) arising from your use of our Site or violation of these Terms.

10. Limitation of Liability

To the fullest extent permitted by law, Ho! Ho! Ho! Greeting shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Site or Services.
Our maximum liability, regardless of the cause of action, shall not exceed three times the purchase price of the affected Service or $100, whichever is greater.

11. Arbitration Agreement and Class Action Waiver

Any dispute, claim, or controversy arising out of or related to these Terms, the Site, or Services shall be resolved by binding arbitration conducted in New York, USA, under the rules of the American Arbitration Association.

You and Ho! Ho! Ho! Greeting waive the right to a jury trial and to participate in any class, collective, or representative action.

You may opt out of this Arbitration Agreement within 30 days of your first purchase by emailing santa@hohohogreeting.com with the subject line “Opt-Out of Arbitration Agreement.”

12. Termination of Services

We reserve the right to suspend or terminate access to the Site or any Service at any time for any reason, including suspected misuse or violation of these Terms.

13. Modifications

We may modify or update these Terms at any time. The most current version will always be posted on this page with the effective date. Continued use of our Site or Services after changes take effect constitutes acceptance of the revised Terms.

14. Transfer of Information

In the event that Ho! Ho! Ho! Greeting is acquired, merged, or sold, customer information may be transferred as a business asset, subject to the same privacy commitments in place at the time of transfer.

15. Governing Law

These Terms and any disputes arising hereunder are governed by the laws of the State of New York, without regard to conflict-of-law principles.
